Abstract

Explores the European Court of Justice decision in Vlaamse Federatie van Verenigingen van Brood- en Banketbakkers, Ijsbereiders en Chocoladebewerkers (VEBIC) VZW (C-439/08) on whether the appeal provisions of Regulation 1/2003 should be interpreted so as to require that national competition authorities are allowed to participate as defendants in proceedings where the correctness of their own decisions under EU law is at issue. Notes that this is the first time that the court has ruled on this issue, rather than deferring to Member State autonomy, and that national practice varies widely.
