Regulating the Employment Relationship in Professional Team Sports

Abstract

A sporting code’s governing body is a private association of members that frequently exercises monopoly power in the sport over which it presides. In a professional team sports competition, a sporting code’s governing body may prescribe standard terms and conditions of employment, organise the competition and adopt regulatory measures which directly or indirectly affect the employment interests of players. In most relevant circumstances, a sporting code’s governing body is not obliged to inform, consult with or seek the agreement of players prior to the implementation of a regulatory measure that directly or indirectly affects a player’s employment. Strengthening the regulation of professional sport through competition law could balance the employment interests of players with the commercial and regulatory interests in a professional sports competition. Establishing a direct employment relationship between players and the sporting code’s governing body would also assist.
