Abstract

Comments on the General Court judgment in CDC Hydrogene Peroxide Cartel Damage Claims (CDC Hydrogene Peroxide) v European Commission (T-437/08) and the European Court of Justice ruling in Pfleiderer AG v Bundeskartellamt (C-360/09) on whether alleged victims of competition law infringement could pursue private enforcement by demanding the disclosure of alleged cartelists' leniency applications. Reports on the Commission proposal in the 2012 work programme to introduce legislation to protect leniency initiatives.
