Abstract

Describes the procedure for authorising the calendar for international competitions under the Dutch National Federation of Equestrian Sports (KNHS) rules in order to avoid conflict and the duplication of dates. Examines, pursuant to the competition law provisions contained in the Treaty on the Functioning of the European Union arts 101 and 102, whether: (1) the KNHS is considered an undertaking; (2) the authorisation rule used by the KNHS restricts competition; (3) trade between Member States is affected; and (4) the rule fulfils the conditions of art.101(3). Considers the relevance of art.165.
