Abstract

Discusses the implications, for the power of the Belgian Competition Council to refer disputes to the national Court of Cassation on points of law, of the outcome of the parallel appeal to the Brussels Court of Appeal, on the ground that referral should not suspend the merger control time limits, against the referral decision in Tecteo / Brutele. Speculates on the outcome of the related proceedings before the Court of Cassation.
